Terms of Service

Welcome to SnapRockz ("SnapRockz", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the SnapRockz website, applications, and services (collectively, the "Service"). By creating an account, purchasing a gallery, uploading photos, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase a paid gallery or create an account. By using the Service you represent that you meet this requirement.

2. Accounts and Galleries

A "Gallery Owner" is the person who creates and pays for a gallery. Guests may upload photos to a gallery without an account by entering only a display name. Gallery Owners are responsible for moderating their own galleries, including hiding or deleting any photo or comment that violates these Terms.

3. Acceptable Use

You agree not to use the Service to upload, share, or transmit any content that:

  • is unlawful, harassing, defamatory, hateful, or threatening;
  • is sexually explicit, exploits minors, or depicts non-consensual nudity;
  • infringes another person's intellectual property, privacy, or publicity rights;
  • contains malware, viruses, or any harmful code; or
  • is spam, advertising, or unsolicited promotional content.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, with or without notice.

4. Your Content

You retain ownership of all photos and content you upload. By uploading content to a gallery, you grant SnapRockz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and providing the Service to you and the gallery's intended audience.

Guests who upload to a gallery grant the Gallery Owner the right to download, retain, print, and personally use those photos. Gallery Owners may not sell guest-uploaded photos without the uploader's permission.

5. Payments

Paid galleries are billed as a one-time purchase processed by our payment provider, Paddle.com Market Limited ("Paddle"), which acts as the merchant of record. Your purchase is also subject to Paddle's terms. All prices are listed in U.S. dollars unless otherwise stated and may include applicable taxes collected by Paddle.

6. Refunds

Our refund policy is set out in our Refund Policy, which forms part of these Terms.

7. Service Availability and Data Retention

We work hard to keep the Service available and your photos safe, but we do not guarantee uninterrupted access. You are strongly encouraged to download a ZIP archive of your gallery after your event for your own backup. We may retain or delete inactive galleries in accordance with our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, SnapRockz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service will not exceed the amount you paid to SnapRockz in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold SnapRockz harmless from any claims, damages, or expenses arising from content you upload, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination will survive (e.g., ownership, disclaimers, limitations of liability, indemnification).

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by additional notice.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.
